were initially approved by the agency (limitations,
operation, performance).
Of interest for any DOA, the safety management
system may find its way into Part 21 soon. A notice
of proposed amendment is planned for 2014 and the
rule for 2015.
The rulemaking task on flight testing (RMT.0218)
is proposing a flight test operations manual as part of
DOA. This manual will have to include the processes
exercised by the DOA performing such tasks and will
identify test pilot and flight test engineer competence
and experience assessments.
News discussed impacting the general aviation
community include the reorganization of CS-23 (Part
23 equivalent). The rulemaking effort is to move current regulations text into industry standards (ASTM).
An interesting effort is the work on new types of
parts, which are identified as nonaviation and/or nonrequired mission parts that may not need a Form 1 to
be issued in the future.
Another major rulemaking task is the continued
development of a clearer definition and rulemaking
about instructions for continued airworthiness. This
task includes definition and availability of ICA to
customers as well as approval of ICA by other than
DOA.
The presentation on certification memoranda first
presented in January 2011 included an update of
ongoing and completed CMs. EASA identified that
a CM could become a candidate for rulemaking and
will have a numbering system introduced, which
allows to easy relate a CM to a CS code. A tool to
allow email notification sent to industry association
representatives prior to the official proposal was
requested by the industry. A further extension of the
public consultation to six weeks also was announced.
It was insisted by the agency that a CM is clearly not
a rule, and if an expert wants to impose the contents
on a project, this should be done by starting a communication and agreement with the applicant.
Another topic of major impact to the industry was
the so-called level of involvement. The LOI identifies to which level and how thorough the agency
is checking individual documents prepared by the
DOA. It was first publicly discussed as part of NPA

16-2006. There is no common agreed level for such
involvement yet; however, the goal is not to reduce
the safety level. The intention is that once SMS is
implemented (will be implemented in parallel with
the new LOI process), any LOI action claiming the
compliance showing is not sufficient will automatically raise a finding on the organization. The organization that reached the highest level of confidence
will have the least burden with agency involvement.
A presentation on the bilateral agreement between
the U.S. and Europe (FAA and EASA) has identified
Revision 2 to the technical implementation procedure
as recently published. There are continued consultations on the introduction of Croatia (new member
state in mid-2013) and the four EFTA states (Norway,
Iceland, Switzerland and Lichtenstein) into the existing arrangement.
The agency also used the chance to inform the
industry on the status of the Internal Occurrence
Reporting System. It reaffirmed the objective is to
improve oversight where the agency is competent
authority by ensuring the systematic follow up. It
also highlighted its current effort is to include ATM/
ANS and approved training organizations into the
reporting system. Continued airworthiness was part
of the initial process. The other objectives are to
gather information and provide a knowledge database
on continued airworthiness to support cross-product
analysis and support rulemaking activities. Internal
and external cooperation and communication was
identified as the key principle. The IORS system including the Form 44 has been fully operational since
February 2012.
Future extensions to the IORS project are foreign
TC Holders, OSD, RVSM and the Single European
Sky transponder requirement. In the nonproduct related area, approved flight-training organizations and
third-country operators are identified as a new focus.
Presentations of GAMA, ASD and others stressed
the importance of the continued cooperation and
coordination of EASA with the industry representation bodies. A number of examples were presented by
these groups and included the continued development
of the changed product rule, certification memoranda
and standards for the LOI. q
