states in order to determine the status of an aircraft’s title.

In fact, the U.S. Supreme Court
has confirmed the federal recording
system for aircraft that is managed
by the FAA pre-empts state recording
mechanisms for aircraft. Many states
have their own statutes reinforcing

this notion. For example, Florida’s
laws state that a lien is not valid
against an aircraft (with respect to
third-party owners without notice of
the lien) until and unless it is filed
with the FAA’s registry.
There also can be special state
requirements for notice. For
example, the state of California
has special requirements for the
information that has to be in the
filing provided to the FAA (in
order to make it enforceable under
California law), and California
requires a copy of the lien information that is provided to the
FAA also must be sent to both the
registered owner and the person
consenting to the work. California
also has a law that may limit the
validity of a lien unless the repairman who later intends to assert
a lien (1) notifies both the legal
owner and the mortgagee (if any)
of the aircraft, and (2) obtains the
prior written consent of both the
legal owner and the mortgagee of
the aircraft before the work is performed. If the repairman has not
obtained such written permission,
then his lien may be limited to not
more than $250.
While some states say that FAA
registry filing is sufficient and that
no filing in the state is required,
other states have special requirements related to state filing, like
the Missouri state requirement to
file copies of the lien statement (1)
in the office of the county recorder
of the county where the owner of
the aircraft or part or equipment
thereof resides, if known to the
claimant, and (2) in the office of
the county recorder of the county
where the labor or material was
furnished, in addition to (3) the
FAA registry.
