is punishable under Florida law as
a felony. These are not idle threats
– courts have permitted the states to
seize unregistered aircraft.
Despite laws requiring registration, it is still possible to discover
that an aircraft is not currently
registered. Part of the reason for
this is because of a July 20, 2010,
legal change that makes aircraft
registration nonpermanent. Despite
the original intent that registration
be the method for recording titles
to ensure the government is able
to properly identify the owner of
each aircraft, the FAA changed the

registration rules to cause registrations to expire after three years
(requiring renewal – the official
reason for this change was to ensure
“more accurate, up-to-date registration data”). If the registration is not
timely renewed, then the aircraft’s
N-number will be canceled approximately 90 days after the expiration
of an aircraft’s registration. Upon
cancellation, an N-number will be
unavailable for assignment or reservation for a period of five years.
If aircraft registration has expired
and the N-number has been canceled, application may be made to

register the aircraft under 14 CFR
§ 47.31, using the standard application for registration and payment of
the $5 registration fee.
How does this relate to liens?
Well, if the aircraft is not registered,
then the FAA will not accept a lien
against the aircraft for filing. The
reason for this is simple – there
is no longer a registration against
which to record the lien. This means
that if a repair station has obtained
a lien against an aircraft no longer
