Civil Aviation Safety Agency
The Australian government's Civil
Aviation Safety Agency published the
NPRM 1305AS - Carriage of ADS-B
avionics in foreign registered aircraft
operating in Australian territory, and it is
now available for comment. The comment
period closes Jan. 10.
CASA also published an amended
Acceptable Means of Compliance/
Guidance Material - CASR Part 66 -
Continuing Airworthiness - Aircraft
Engineer Licences and Ratings and AAC
9-1 - Aircraft Maintenance Engineer
(AME) Licensing Examinations (Issue 28)
on the CASA website.
The AEA is now participating on a
new Part 66 Small Aircraft Maintenance
Licence working group. The working
group discussed the following five discussion papers at the December meeting:

DP 1214SS - Maintenance of
non-RPT aircraft.
DP 1207SS - Continuing airworthiness management requirements
for non-RPT aircraft.
DP 1208SS - Maintenance programs for non-RPT aircraft.
DP 1206SS - Airworthiness
reviews for non-RPT aircraft.
DP 1215SS - Maintenance personnel licensing for small aircraft.

which all articles that are included on the issued export license transition
to the CCL. Such a license will remain valid for two years from the effective date of the final rule (Oct. 15, 2013), which means Oct. 15, 2015, or
until the license expires, whichever occurs first. Until that time, there is no
need to apply for a new export license, and the distributor may rely on the
export license as usual.
The second scenario considers an export license in which only some
of the articles included on the license transition to the CCL, but others
remain on the USML and subject to the ITAR. In this case, the export
license will remain valid until it expires, whether the expiration date is
prior to Oct. 15, 2015, or not. This means that those distributors who
find a DSP-5 now lists a mix of USML and CCL items may continue
exporting pursuant to that license beyond the Oct. 15, 2015, cutoff
date, assuming the license has not previously expired.
Of course, in both cases a license may still be voluntarily returned to
the DDTC or otherwise suspended, revoked or terminated.
Ultimately, in the short term, those companies exporting pursuant to
a DDTC export license issued prior to Oct. 15, 2013, may continue to
export under the terms of their validly issued export licenses. The key
factor is that if it is determined that all articles authorized on the license
have transitioned to the CCL, the distributor may only continue to
export under the license until Oct. 15, 2015, at the latest. After Oct. 15,
2015, companies wishing to continue to export those articles that have
transitioned to the CCL must apply to BIS for the appropriate export
licenses, or ship under a valid exception. Export licenses that continue
to authorize at least one article still on the USML will be valid until
expiration, at which point application must be made to BIS for future
export licenses.
One final important reminder is that not all USML Categories have
yet undergone revision under the Export Control Reform Initiative.
Notably, USML Category XII (fire control, range finder, optical and
guidance and control equipment) has not yet undergone revision. Those
companies that manufacture or export articles, such as lasers, infrared
focal plane array detectors, image intensification and other nightsighting equipment or systems, military image intensification tubes, or
infrared, visible, and ultraviolet devices, specifically designed, modified or configured for military applications, should continue to pay
close attention to USML Category XII to ensure ongoing compliance.
The ongoing revisions to the USML and CCL are a positive step,
both in facilitating trade and in helping exporters remain compliant
with export regulations. Exporters should remain vigilant for future
changes to the USML and CCL, and take steps to ensure that their
export compliance systems are continuously updated to reflect the
current state of the regulations. With vigilance toward compliance,
these changes will facilitate and expedite the export of many former
ITAR-controlled articles and result in a significant benefit to the aviation industry. q
