News & Regulatory Updates
Europe has delayed the mandate for ADS-B Out equipage
of aircraft in its airspace. The new ADS-B Out requirement
deadline is June 8, 2016, for new aircraft and June 7, 2020,
for retrofit. The new dates are more closely aligned with the
U.S. retrofit requirement.
Meanwhile, the EASA has issued a Certification
Specification CS-ACNS, in which the minimum operational
performance is identified.

Australia
The Australian government's Civil Aviation Safety Authority
has a number of draft advisory circulars that may affect avionics.
All comments should be sent to the project leader, Ben Challender.
* Draft AC 21-28 v1.0 - Approval of modification and repair
designs under Subpart 21.M.
* Draft AC 21-12 v1.0 - Classification of design changes.
* Draft AC 21-15 v3.0 - Supplemental type certificates.
* Draft AC 21-26 v1.0 - Certification conformity.
In addition to the draft documents that are open for comment,
the CASA has published the following documents:
* Advisory Circular - AC 21-36 v2.1 - Global Navigation
Satellite Systems Equipment: Airworthiness Guidelines.
* CAAP 35-7(0) - Design approval of modifications and
repairs has been cancelled/removed from the CASA website.
Civil Aviation Order 82.6 Amendment Instrument 2014 (No.
1) has been registered on the Federal Register of Legislative
Instruments and came into effect Sept. 1, 2014.
Civil Aviation Order 82.6 (CAO 82.6) established operational
and airworthiness standards and approval requirements for the
use of night vision goggles in specialized helicopter aerial work
operations. The CAO had, and has, the effect of making unlawful
any unapproved use of NVG as a primary means of terrain
avoidance for safe air navigation by means of visual surface
reference external to an aircraft. The CAO is an interim measure
pending finalization of relevant parts of the Civil Aviation Safety
Regulations 1998 that affect the use of NVG. However, three of
those parts took effect Sept. 1, 2014, namely Part 61 dealing with
flight crew licensing; Part 141 dealing with certain pilot flight
training; and Part 142 dealing with integrated and multicrew pilot
flight training and contracted recurrent training and checking. It
is, therefore, necessary to amend CAO 82.6, to take account of
new language and certain substantive changes arising from the
new parts that have an impact on CAO 82.6 and the use of NVG.
CAAP 35-7 provided information and guidance for approval of
modifications and repairs under regulation 35 of CAR. Regulation 35
of CAR was repealed by the Civil Aviation and Civil Aviation Safety
Amendment Regulations 2011 (No. 1).
Modification/repair designs are now approved under Subpart
21.M of CASR. See AC 21-8 - Approval of modification and
repair designs under Subpart 21.M currently being developed under
Project CS 99/04 - CASR Part 21 Subpart J - Approved Design
Organizations, for information and guidance on Subpart 21.M.
CAAP 30-6(0) - Certificate of Approval - Design Organizations has
been cancelled/removed from the CASA website. CAAP 30-6 provided
guidance in relation to certificates of approval under regulation 30 of
CAR for design organizations.
Following the commencement of the Civil Aviation Legislation
Amendment (Subpart 21.J) Regulation 2013, regulation 30 of CAR no
longer provides for approval of design organizations (although noting
that the transitional regulations provide for certificates of approval under
regulation 30 of CAR to continue until March 2017). Australian design
organizations are now approved under Subpart 21.J of CASR.
Final disposition for the Subpart 21.J amendment has been provided
to the industry via NFRM CS 99/04 - Subpart 21.J legislation
amendments, and guidance material will be provided via AC 21.J-01
- Approved design organizations (being developed under Project CS
99/04 - CASR Part 21 Subpart J - Approved Design Organizations.

Industry Professionalism
In the August issue of Avionics News, Thomas Inman
penned an excellent review of the avionics profession and
professionalism overall. I encourage all to read it. There is
one area of the article where I'd like to expand - the area of
professionalism. Under the heading "Guidelines for behavior,"
the author cites the need for industry-wide "code."
As the AEA's vice president of government and industry
affairs, I have worked on the Aviator's Model Code of Conduct
for nearly a decade and been a member of the permanent
editorial board of the AMCC for the past five years. In addition
to the basic AMCC, there are seven additional model codes
for most of the disciplines of aviation, including the aviation
maintenance industry. While not specific to only avionics, the
AMT Model Code of Conduct does exactly what the author
was looking for; it defines the guidelines, commitment and
statements on ethics and professionalism in support of the
aviation maintenance (including avionics) industry.
The Aviation Maintenance Technicians Model Code of
Conduct, like all of the AMCCs, are a free public service to the
aviation community. The Codes are designed to be downloaded
and customized for your particular business. The AMTMCC
can be found at the Aviator's Model Code of Conduct website at
