New partners: Iran and Cuba?

N

ew markets are opening up
to the Aircraft Electronics
Association's membership
in some seemingly unlikely places
such as Cuba and Iran.
Historically, AEA members
around the world have refrained
from doing business with partners
in places like Iran and Cuba. Those
in the U.S. have been subject to
specific laws that generally forbid
transactions with business partners
in Cuba and Iran. But that is
changing.
Relations between the U.S. and
these nations are beginning to
normalize. One of the first steps
in that normalization process is to
permit the sale of aircraft parts to
operators in these countries, and
to also permit some maintenance
work, as well.
We are still in the early stages
of the normalization process, so
the general rule remains one of
exclusion. Americans are still
generally prohibited from doing
business or investing in Cuba and
Iran. If you apply for a license, you

will find there is a general policy of
denial of license applications when
the destination is Iran or Cuba. If
the part was manufactured in the
U.S. or if it otherwise originated in
the U.S., you should only export an
aircraft part from the U.S. to one of
these countries if you have obtained
a license from the U.S. government.
So how do you get one of these
licenses?

This past summer, the parties
to the Iran talks announced that a
Joint Comprehensive Plan of Action
had been reached. Included among
the provisions was a clause that
will permit the sale of commercial
aircraft, parts and services to Iran.
It states that the U.S. shall:
Allow for the sale of
commercial passenger aircraft
and related parts and services

U.S. trade delegations are now authorized to
travel to Cuba in limited situations. For example,
travel to Cuba is authorized when it is incidental
to exporting authorized goods.
Iran
The Iranian program is the older
program.
Since Nov. 24, 2013, the U.S.
operated under a Joint Plan of
Action with Iran that has permitted
the export of commercial aircraft
parts to Iran (when licensed by the
U.S. Treasury Department's Office
of Foreign Asset Control) during
negotiations.

lease or transfer to Iran of
commercial passenger aircraft
for exclusively civil aviation
end-use, (ii) export, re-export,
sale, lease or transfer to Iran of
spare parts and components for
commercial passenger aircraft,
and (iii) provision of associated
services, including warranty,
