The letter of agreement question:
Where is an LOA needed?
Currently - and this can be a moving target - the FAA
does not require an LOA for ADS-B Out operations in
U.S. airspace but the requirements exist elsewhere in
the world. To that end, Advisory Circular 90-114 states
that all U.S. operators must receive FAA authorization
to conduct international ADS-B Out operations, either
in the form of the original LOA process, A353, or its
replacement from last August, A153. But regional
authorizations may apply, so check the nation you plan
to visit.
Currently, neither the U.S., Australia or Fiji require an
LOA for ADS-B Out operations, but that may change as
ADS-B systems grow internationally.
Currently, several regions of China, Hong Kong,
Singapore and Vietnam do require an LOA; these nations
and Canada have a conditional requirement in effect,

usually based on airspace or specific routes.
Meanwhile, the list of countries requiring LOA and any
conditions in effect may grow. The Aircraft Electronics
Association and the FAA can both help affirm whether a
nation on your itinerary enforces the LOA requirement.
Which LOA? A353 or A153?
Heeding two years of complaints about an overly
lengthy, complicated process moved the FAA to enact
a new LOA for international ADS-B Out needs - A153.
The new form not only superseded the original - A353
- the new process also reduced the overall requirements,
simplified the process and moved approval back to FSDO
inspectors from the regional offices where the agency
originally vested approvals of A353 applications.
The change was an answer to those complaints and
a sluggish process for approving applications. For
international use, however, either LOA works. So unless
an operator has an application pending under A353, A153
is the way to go, according to avionics shops and operators
who've completed the process. q
