The standards contained within the
international aviation agreements are
dynamic and constantly changing. Repair
shops are encouraged to regularly review
the agreement applicable to any aircraft or
component they are servicing.

national authorities, and as a result, their aviation
industries. However, while some agreements are bilateral
and balanced, many of these agreements are onedirectional. As a result, you cannot assume that since one
country accepts goods and services from another country
that the acceptances are mutual and equal. You must do
your research.
As an example, there are 48 bilateral aviation safety
agreements (or its predecessor, bilateral aviation
agreements) between the U.S. and other countries. Of these,
more than half are incorporated in the agreement between
the U.S. and the European Union. Of the 48 agreements,
only three (Canada, EU/EASA and Switzerland) contain
maintenance implementation procedures.
Following is an example of where the BASA contains
information that may be different than common thinking.
It is generally understood that you are required to
have FAA documentation for parts to be installed in a
U.S.-registered aircraft. However, 14 CFR Subpart N -
Acceptance of Aircraft Engines, Propellers and Articles
for Import - states that an article manufactured in a
foreign country meets the requirements for acceptance if
that country is subject to the provisions of an agreement
with the U.S. for the acceptance of that article.
According to the U.S./EU BASA:
The following new parts manufactured under a French
POA that conform to FAA-approved design data and are
eligible for installation in a product or appliance which
has been granted an FAA design approval (accompanied
by an EASA Form 1, or a JAA Form One issued before
Sept. 28, 2005):
* Replacement parts regardless of the state of design
for the product and/or appliance.
* Modification parts for design changes where

EASA acts as the state of design for the design
change for an EU applicant. When these
modification parts are associated with an EASA
STC, the STC must be within the scope of the
technical implementation procedures.
* Modification parts for any product where the U.S.
is the state of design for the design change and
the parts are produced under licensing agreement
to the U.S. design approval holder (split state of
design and state of manufacture).
I actually came across this issue a few years ago when
an AEA member shop had changed engine mounts on
a Tobago using mounts that were direct shipped from
the aircraft OEM (Socata) with the appropriate JAA
paperwork. Sometime later, an uninformed mechanic
with an inspection authorization "grounded" the aircraft.
The local FAA also failed to recognize that the parts
were covered under Subpart N and the U.S.-French
BASA and supported the IA's grounding. Although it
took some time, we were able to educate all parties and
the aircraft was returned to flight.
Most of the bilateral agreements address repair data,
and as indicated with the BASA between the U.S. and
Canada, may accept each other's repair data. But note,
this is for repair data, not alteration data. In every case,
alteration data must be approved by the state of registry
of the aircraft.

4.2.0.1 Acceptance of Repair Design Data
