ADS-B Out Requirements
for non-U.S. aircraft
The following information is from the Federal
Aviation Regulations.

QUESTION:
With all of the focus on U.S.-registered aircraft ("N" registered), what are the requirements for non-U.S.-registered aircraft?

ANSWER:
The ADS-B Out rule is an airspace rule. As
such, it applies to any aircraft flying in ADS-B
airspace regardless of the state of registry of
the aircraft. The challenge for international
aircraft is to ensure that any ADS-B installation
meets not only the intended requirements for
flights in their national airspace, but also the
intended airspace of any foreign airspace.
With the exceptions granted for approval for
manufacturing deviation contained in 14 CFR
§ 21.618, the following is the airspace operating
rules for ADS-B in U.S. airspace:

Basic STC
The following information is from the Bilateral Aviation Safety
Agreement between the United States and the European Union.

QUESTION:
In recent presentations, there has been a reference to
the term "Basic STC." What is a Basic STC?

§ 91.225 Automatic Dependent SurveillanceBroadcast Out equipment and use.
(a) After Jan. 1, 2020, and unless otherwise
authorized by ATC, no person may operate
an aircraft in Class A airspace unless the
aircraft has equipment installed that -
(1) Meets the requirements in TSO-C166b,
Extended Squitter Automatic Dependent
Surveillance-Broadcast
and
Traffic
Information Service-Broadcast Equipment
Operating on the Radio Frequency of 1090
megahertz; and
(2) Meets the requirements of § 91.227.
(b) After Jan. 1, 2020, and unless otherwise
authorized by ATC, no person may operate an
aircraft below 18,000 feet MSL and in airspace
described in paragraph (d) of this section unless
the aircraft has equipment installed that -
(1) Meets the requirements in -
(i) TSO-C166b; or
(ii)
TSO-C154c,

Transceiver
Automatic
Dependent
Surveillance-Broadcast
Equipment
Operating on the Frequency of 978 MHz.
(2) Meets the requirements of § 91.227.

ANSWER:
From the definitions section: "Basic Supplemental
Type Certificate" means a supplemental type certificate
whose validation does not require validating authority
technical involvement.
"Validating authority" means the FAA for import into
the U.S.; EASA for import into the European Union.
