license requirements under the MT,
or missile technology restrictions.
If your avionics are subject to
MT restrictions, then they will
generally need an export license
when exported anywhere other than
Canada. This includes exports of
those units to close U.S. allies, such
as the United Kingdom, Japan and
Australia.
License exceptions for
MRO work and for warranty
replacement
Because of the need for export
licenses for these and other articles,
it is important for the avionics
community to be familiar with export
licensing exceptions that can help
expedite the shipping transaction.
Let's suppose you are shipping
a normal avionics unit that has
been identified as falling under a
missile-technology-restricted export
classification (like ECCN 7A103).
You are shipping to Germany. This
would normally require a BIS license.
But among AEA members, the first
two questions I might ask would be,
"Why did you have the unit in the
first place (what kind of transaction
is this), and can we take advantage
of a license exception?" The nature
of your transaction may provide
opportunities to avoid the need to
spend time obtaining a license.
If you had the unit for inspection,
testing, calibration or repair
(including overhaul), then you may
be able to use the "servicing and
replacement of parts and equipment"
exception found in the Commerce
Department regulations. The work
is not permitted to have improved
or changed the basic characteristics
of the unit. A good clue: If the
work required a change in dash
number, then this should serve as
a red flag that there might have
been an improvement or a change
in basic characteristics. Note that
even a software upgrade can reflect

to make sure you follow the right export regulations and
protocols when the article is returned.

review the scope of work carefully
(for example, an upgrade of TCAS
software to MOPS 7 could add
RVSM capabilities, which would
change the unit's functionality).
In addition, if you have the
unit for replacement (a warranty
replacement or an exchange, for
example), then you may make use
of a different portion of the same
Commerce Department exception.
In this case, you have to make

sure that you get the core (the unit
that is being replaced) or that you
confirm its destruction. This means
that the exception may not be
compatible with traditional exchange
transactions, which often provide
an option to submit a core within
a certain period of days, or pay an
outright price as an alternative. If
the customer pays the outright price,
then you have failed to meet the
