radios or transponders - though options exist for them
to comply, as they do for sailplanes.
Beyond those aircraft, we know many other aircraft
originally delivered with an electrical system will also
miss the deadline - and their airspace access will suffer
for the lack of ADS-B Out compliance.
Actually, lacking ADS-B Out won't automatically
ground a plane. But lacking ADS-B Out means the pilot
will face new conditions and constraints to access some
airspace sectors - Class B and Class C tops among them.
But in other parts of the sky, ADS-B Out isn't
required by the final rule the FAA issued back in 2010.
So let's start by examining where ADS-B Out will be
required.
ADS-B Out requirement - By the airspace
The must-comply airspace looks and reads simply
enough - until you consider that terrain elevation varies
significantly across the continental 48 states in the U.S.
along with Alaska and Hawaii. The illustration above is
the basic rundown of airspace-dependent requirements,
by graphic and by chart.

The sharp-eyed among us should note a call-out on the
graphic depicting the ADS-B Out airspace requirements
- a break in which ADS-B Out solution can be used.
Below Flight Level 180 - 18,000 feet above mean sea
level - either of the two ADS-B Out options meet the
FAA rules: a Universal Access Transceiver or a Mode S
transponder with Extended Squitter, commonly called
1090 ES transponders.
Outside Class B and Class C airspace - and that's most
of the country - ADS-B Out is not required for flying
below 10,000 feet msl across the lower 48 states. Above
