require ADS-B at all altitudes - or
only above a certain altitude, as
some countries have adopted.
Just one more consideration to
weigh for operators still straddling
the fence about how and when to
comply with the FAA mandate. Ditto
for the earlier deadlines of some
countries. Operators heading outside
the U.S. should double-check the
countries they plan to visit - or fly
over - to determine whether ADS-B
Out is already required.
And remember, if it is already
required, it will be based on the
1090 ES system.
An FAA extension of the
deadline: A hollow hope
For aircraft already transponder
equipped - and their owners - hopes
for an extension of the Jan. 1, 2020,
deadline are, as one FAA official
noted at AirVenture Oshkosh this
year, "a hollow hope" because
the agency feels that nearly 10
years is more than sufficient time
for America's aircraft owners to
comply.
"And that early complaint about
the lack of solutions - particularly,
affordable options - no longer holds
merit," one agency staffer explained.
"Back at the start, in 2010 through
2012, those complaints held water.
Four years downstream, the options
are vast and far more affordable."
In the interim, the industry has
added numerous options, a couple of
programs to help owners pay for the
upgrade, and even a federal rebate
program - now in progress after
Sept. 19 of this year.
"Today, the question is less about
finding an affordable solution or
finding the bucks and more about
booking an installation slot - and
that limitation will only get more
acute the closer we get to New
Year's Eve 2019," the FAA insider
observed.

And another rumored piece of
scuttlebutt is that the FAA will
relent and allow some portable
and/or non-TSO'd solutions to the
ADS-B Out mandate.
Operators of light sport aircraft
and experimental, amateurbuilt aircraft are the exception
to the TSO-required rule, but
regulatory conditions remain. The
manufacturer of, for example, a
non-TSO'd WAAS GPS receiver
may be legal in EAB and LSA,
providing the manufacturer shows
that the unit meets the technical
requirements of the TSO. We've
seen the FAA approve nonapproved
hardware for use in certificated
aircraft following similar lines -
such as the Experimental Aircraft
Association's TSO allowing
installation of Dynon's EFIS-

D10A and EFIS-D100 primary
flight displays in place of attitude
indicators in certificated aircraft
and Garmin's G5 unit.
In fact, Dynon offers a rulecompliant WAAS GPS receiver for
use with its displays in LSA and
EAB aircraft. It's not TSO'd but
works as a position source in an
ADS-B Out system.
Portable devices, however,
remain a long shot prospect,
according to several association
and FAA staffers. That means
something must be installed - and
meet the appropriate requirements
for aircraft that require an ADS-B
Out solution.
Meanwhile, the calendar
pages keep turning and the clock
continues to tick down to midnight,
Dec. 31, 2019. q
