Self-disclosure as a
safety strategy
T

hey say that how one operates under adversity is
the true measure of a person's worth. In fact, my
family's coat of arms bears the motto "Crescit Sub
Pondere Virtus," which means that virtue increases under
adversity.
What do you do when something goes wrong?
Many years ago, I represented a repair station that was
preparing for a major scheduled audit from the Federal
Aviation Administration. The owner had purchased the
facility and found that there was a locked room in the
facility. No one had a key - including the seller who said
that he'd never opened the door during his ownership. The
purchaser meant to get the door opened, but then life got
busy and he never got around to it - until the FAA audit
was around the corner.
The upcoming audit was known as a NASIP, which
stands for National Aviation Safety Inspection Program. It
was part of an FAA effort to standardize auditing practices
across the nation. I knew that with the mix of auditors we
would get, there was no way they would permit us to tell
them there was a locked room to which no one had a key.
So I insisted that we get the door open.
We were able to remove the door, and behind the door
we found a room full of old, corroded, engine parts. Many

were parts for engines no longer actively flown in commercial aviation. These parts appeared to have been locked
away for more than a decade.
The repair station's practice was to destroy engine
parts that could not be salvaged, to prevent misuse, and
it mutilated these parts that same day to disposition them
as scrap. But in addition to their safety concerns, another
motivating drive of the repair station management was to
avoid getting caught with "bad" parts that the FAA inspectors might mistakenly think were part of the repair station's warehouse stores.
The repair station management feared that the FAA inspectors would not accept the truth about the parts. It is this sort
of fear that hinders our industry from moving forward into
our next evolution of safety. We need to be able to share
information with the FAA - all information (good and bad) -
in order to facilitate effective safety-decision-making.
Lawyers' advice
When something goes wrong, it is normal for lawyers
to tell their clients to preserve confidentiality. Do not go
telling the world - especially the government - about the
issues. Instead, seek to address them in-house. Correct the
problems. And do not open the door to litigation or pros-
