the oversight of repair stations. At the NBAA
Convention in early November, I spoke to the FAA
about industry problems created with the agency's
lack of managing the natural and predictable action
of two inspectors disagreeing with each other, and
how there are millions of dollars of property that
are being "taken" by the agency because of the lack
of a reasonable management plan. Yes, contrary to
the Washington "speak," it is much more common
than you think. And no, the existing processes
for challenging a decision do not work for small
businesses.
According to a longtime friend who retired from
the agency a few years ago, if I criticize, I should
also offer a solution. So here it goes.
Let's look at the foundational philosophy:
Just Culture, empowerment, managing risk and
consistency. Notice I did not say standardization.
Until each and every business is standard, I do
not want the oversight of those to be standard. I
don't want the businesses that invest in training,
education, equipment and staffing to be treated the
same as those that barely get by.
But consistent interpretation of regulations,
guidance and policy is necessary and mandatory.
How do you get a consistent answer from the
administrator (and his 5,000 representatives) all the
time? You can't, and it is not reasonable to expect
that you can. So there are two essential practices
that must take place.
First, taken from Part 145, The administrator
must have and use an employee training program
that consists of initial and recurrent training.
In addition, the measure of effectiveness of the
training is that the training program must ensure
each employee is capable of performing the
assigned task.
Second, when a representative of the
administrator disagrees with another representative
of the administrator, they need to take it behind
closed doors to resolve it. The public should not
be subjected to this see-saw of opinions. If I met
the regulations on Monday, it is logical that I
meet the regulations on Friday. Just because the
FAA assigned a new inspector, my business didn't

change nor should the assumption of "acceptable"
procedures.
In The Nordrstom Way, if an employee makes
a "wrong" decision, they are counseled and
retrained, but the customer never sees what happens
after the fact or behind the curtain. Unless there is a
critical safety of flight situation, the agencies must
take employee disagreements (especially those that
affect commerce) offline and behind closed doors
for resolution, but allow the industry to operate
while the disagreement is being resolved.
It is critically important that the agency empower
its workforce to the maximum extent possible
for the efficient and timely management of the
industry. However, with empowerment must
come a Just Culture. Paraphrasing Eurocontrol,
the decision-makers, field inspectors, engineers
and managers cannot be "punished for actions,
omissions or decisions taken by them which are
commensurate with their experience and training."
The workforce must be free to make "the best
decision" without fear of retribution.
Finally, understand that the authorities' approach
to a Just Culture within their workforce sets the
model of a Just Culture for the industry. If it is
truly the intent of safety management to manage
risk, it requires a Just Culture to offer open and
honest communications. It requires management
to listen and act upon the information provided.
It requires management to be open to change
and proactively address old-school practices that
impede safety or efficiency.
As this election year comes to a close in the
U.S., one of the most powerful discussions I've
had was about responsibility, and in particular,
personal responsibility. Safety and a Just Culture
must start with you, then be expanded to the shop,
the division, the business and corporate. Yes,
safety requires top-down leadership to support the
activities, actions and attitudes of safety and a Just
Culture, but the responsibility of a Just Culture
starts with you and your everyday approach to risk
management.
