Follow-on installations of
ADS-B Out systems
The following information is from the
Federal Aviation Administration March
2, 2016, memorandum titled: Installation
Approval for ADS-B Out Systems.

QUESTION:

The March 2 memorandum allows for
the reuse of ADS-B Out STC data without
additional approval. What if I need to
deviate from STC data?

ANSWER:

The deviation must be approved. This
would apply for deviation to both the STC
data as well as the approved flight manual
supplement data.
The fundamental reuse of previously
approved STC data is not new or novel;
however, the concept that previously
approved data may be considered approved
does create some confusion. The fundamental
regulations and guidance should still be
considered.
FAA Order 8300.16, Major Repair and
Alteration Data Approval, paragraph 4-2 (e)
previously approved states:
"All previously approved data has to be
applicable to the requested major repair
or alteration. All differences, deviations,
inclusions, and exclusions between the
original use of the data and the current
one must be considered before the data
can be approved for use."

Paragraph 4-2 (e) 3 includes a provision
that "Minor deviations from previously
approved data do not require re-approval."
This typically addresses minor deviations
such as wire routing issues as a result
of configuration changes between the
original STC aircraft and the aircraft being
modified. There are multiple references that
suggest that equipment substitutions are not
considered minor deviations and must be
subsequently approved.
Paragraph 4-2 (e) 3 also includes
important information about cross category
use of data.
"Data that was approved for alteration
of a particular product type (e.g., Part
25 aircraft) may be used to provide
substantiation for a similar alteration
on a different product type (e.g.,
Part 23 aircraft). Typically, data that
meets a more stringent airworthiness
standard when applied to an alteration
requiring a less stringent airworthiness
standard is normally acceptable. The
same is not true for the application of
a less stringent airworthiness standard
to an alteration requiring a more
stringent airworthiness standard - while
not specifically prohibited, it is not
recommended."
While the ADS-B Out policy memorandum
offers a unique consideration for the reuse
of ADS-B Out data, you cannot consider the
policy without also considering the rest of
the regulations and guidance on the reuse of
previously approved data.
