on the installed unit being removed, repaired as necessary, and then
replaced.
Further to this discussion is the difference between a repair and an
alteration. The Part 1 definition of preventive maintenance addresses the
preservation of the aircraft as well as repair of the aircraft through "the
replacement of small standard parts not involving complex assembly
operations." So what is the difference between a repair and an alteration?
The FAA Order 8110.37E, Designated Engineering Representative
Handbook, defines repair as "the restoration of a damaged product or
article accomplished in such a manner and using material of such quality
that its restored condition will be at least equal to its original or properly
altered condition (with regard to aerodynamic function, structural
strength, resistance to vibration and deterioration, and other qualities
affecting airworthiness)." The order further defines an alteration as "the
modification of an aircraft from one sound state to another sound state."
In essence, a repair "restores the aircraft to its current (pre-discrepancy)
design, while an alteration modifies the design."
Preventive maintenance restores the aircraft design to a condition for
safe operation; it does not modify the aircraft design.
The final sentence in paragraph 31 states, "Prior to the unit's
intended use, an operational check must be performed in accordance
with the applicable sections of Part 91 of this chapter." 14 CFR Part
91 Subpart E addresses maintenance, preventive maintenance and
alterations. Paragraph 91.403 (b) stipulates that "No person may perform
maintenance, preventive maintenance or alterations on an aircraft other
than as prescribed in this subpart and other applicable regulations,
including Part 43 of this chapter." In addition to sections 43.3 and 43.7
on persons authorized to perform and return to service maintenance, the
DIYer must also comply with sections 43.5 on return to service; 43.9
on record keeping following maintenance and preventive maintenance
and, of course, 43.13 on the performance rules. And finally, the DIYer
must address the maintenance requirements contained in § 91.405 and
satisfy the aircraft operations after maintenance, preventive maintenance,
rebuilding or alteration as required by § 91.407.
So back to the question of DIY. Unfortunately, it is a Buyer Beware
environment. What I can do with my RV-10 that I cannot do with my
Cessna 172. What I can do with my Beech Baron operated under Part 91
that I cannot do with the same aircraft operated under Part 135. As we all
are aware, the general aviation marketplace is transitioning, and what we
knew to be true yesterday seems to be changing today. Not unlike the TV
series "Rescue my Renovation," there will be opportunities for the astute
certified repair station to "Rescue my Installation."
Rather than debating whether I can or cannot perform a task under
the regulations, I suggest we focus on "Should I perform the task?" Do
I have the knowledge, skills, abilities and tools to properly perform the
task to keep myself and my family safe? We buy the latest and most
advanced technology available, so why would I compromise the safety
enhancements simply to claim DIY? q
