basic (for now). This process is applicable to both
authorities and allows for basic design changes to be
validated purely as an administrative function.
4.	 Other language has changed to allow each authority
to issue an acceptance letter instead of issuing an
STC. However, there is no intention by the FAA at
this point to issue an acceptance letter for validated
STCs. This provision covers the TCCA's current
practice for some STCs.
5.	 Design changes made by a current approval holder
are now accepted by each authority without review
when the TCDS or STC does not require a change
and the design change is classified as basic.
6.	 Exclusive wording of procedures for the FAA- or the
TCCA-only language was combined when there was
an agreed common approach. The use of validating
authority and certifying authority is used instead.
7.	 The section on export certificates of airworthiness
and release certificates has been reworded for a better
understanding of the process.
One element that was added is in regards to the use of
a DER or ODA to meet "data approval requirements" for
Canadian operators or owners. The wording is such that the
TCCA must agree to the use of the FAA designee. But it is
not clear as to what is meant by meeting the data approval
requirements. It also indicates that use of the designee does
not apply where the TCCA must issue a design approval in
accordance with CAR 521. So the question is, what does this
provision do and when can it be used? There is no provision
to allow the use of Canadian DARs or DAOs under the same
circumstances for U.S. owners and operators. A clarification
from the TCCA will be sought.
Overall, this revision is a positive step forward in
simplifying the interactions between the U.S. and Canada,
making it easier to do cross-border work. The validation
process for design changes should prove to be a benefit to
Canadian STC holders. It also appears that, in most cases,
there is harmonization in the acceptance of work on each
side of the border, removing the disparities.

News & Regulatory Updates
European Aviation Safety Agency
As referenced in this month's "View from Washington"
column, the major rulemaking activities affecting the AEA
membership that were discussed at the November meetings
are as follows:
Rules recently adopted by the European Commission:

Regulation (EU) 1536/2015 replaces the term "large
aircraft" by "complex motor-powered aircraft;" introduces
requirements for error capturing methods in the case of
critical tasks; introduces a new Part-T with continuing
airworthiness requirements for aircraft registered outside the
EU when they are operated under the AOC (dry-lease) of an
EU-licensed air carrier; introduces additional requirements
for the NAAs for their Aircraft Continuing Airworthiness
Monitoring program, in particular, the need to use a riskbased approach.
These rules have been applicable since Aug. 25, 2016.
The change in the term "large aircraft" by "complex
motor-powered aircraft" does have impact on some aircraft:
twin-turboprop airplanes below 5,700 kg MTOM (and a
small number of other airplanes) were not "large aircraft,"
but they are "complex motor-powered aircraft" (more
stringent requirements apply). However, twin-engine
helicopters below 3,175 Kg MTOM were "large aircraft,"
but they are not "complex motor-powered aircraft" (less
stringent requirements apply).
The EASA Committee of the European Commission
unanimously agreed to the following on Feb. 17-18, 2016:
*	 New B2L and L Part-66 licenses (ref. Opinion
05/2015).
*	 Procedures Part-145 organizations in order to control
suppliers of spare parts (ref. Opinion 12/2013).
*	 Limitation of the Part-147 privileges related to standalone basic examinations (ref. Opinion 07/2015).
*	 Exemption for twin turbo-prop airplanes less than
5,700 kg MTOM.
The applicability calendar for the above items will be the
following:
*	 B2L license: six months after adoption.
*	 L-license: Oct. 1, 2018 (obligation for NAAs to start
issuing them) and Oct. 1, 2019 (obligation for all
certifying staff to have it).
*	 Part-145 Procedures for control suppliers of spare
parts: six months after adoption.
*	 Limitation of the Part-147 privileges related to standalone basic examinations: immediate effect after
adoption.
*	 Exemption for twin turbo-prop airplanes less than
5,700 kg MTOM: immediate effect after adoption.
Other ongoing tasks:
*	 Task RMT.0276 "Technical records"
*	 Opinion will be published in November 2016.
*	 Task RMT.0281 "New training methods and
teaching technologies"
*	 Opinion planned 2017/Q1.
