The beatings will continue
until morale improves
Do the regulations allow passengers to be beaten?

M

any of you have seen the video in which
United Airlines forcibly removed a passenger
from a flight. I know many of you have seen
it because I received many questions from friends about
the legal standards that applied to this transaction.
In fact, you probably know more than I do about the
incident, because I wrote this article when the incident
was fresh. With the fullness of time, I am sure that more
facts have been revealed in the media.
As we understand from the initial media reports, the
passenger in question was a doctor from Louisville,
who was returning home from Chicago. According to a
letter from United CEO Oscar Munoz to its employees
that was reported by the Chicago Tribune, "after United
Express Flight 3411 was fully boarded, United's gate
agents were approached by crew members that were told
they needed to board the flight."
The airline subsequently described this as an
"overbooked" situation, but the way it was initially
reported in the media, it does not appear the flight
was truly overbooked; rather, the airline decided (after
boarding was complete) to transport four nonrevenue
employees.

The airline asked for volunteers to give up their
seats. There were no takers. Then the airline offered
increasing amounts of compensation. Still no takers, so
it announced that it would be selecting four passengers
to deplane to make room for the four crew members.
The Munoz letter noted that when United "approached
one of these passengers to explain apologetically that
he was being denied boarding, he raised his voice and
refused to comply with crew member instructions." The
airline called Chicago Aviation Security Officers to assist
in removing the customer from the flight. These officers
ultimately dragged him out of the aircraft. In fact, the
media reported that the aircraft had to be subsequently
deplaned to clean the blood from the confrontation.
The public is horrified by the treatment of this
passenger, but let's look at it from the dispassionate
view of the U.S. government legal standards.
Everyone knows that airlines overbook aircraft and
are required to have procedures for dealing with this
situation. The regulatory standards that apply here are
that each air carrier is required to handle "bumped"
passengers with fairness and consistency in the case
of oversales (14 CFR ยง 259.5(b)(8)). The fairness
