CFR § 121.317(k)). There also is a regulation that prohibits a passenger
from interfering with the performance of a crew member's duties on
board an aircraft (14 CFR § 121.580). The latter prohibition is a broad
one, but it is limited by the term "duties."
Under the contract of carriage, a passenger can be removed from a
flight when that passenger refuses to follow the rules.
So the question becomes, did the flight crew have any duty to remove
the passenger in this situation, and did the passenger interfere with that
duty? This is an important inquiry because it currently appears that
the airline is justifying its removal of the passenger on the grounds
that the passenger was "disruptive and belligerent," but it appears that
the disruption was only in response to the attempt to remove him. If
the attempt to remove the passenger was unlawful (and thus was not a
duty), then the refusal to comply with that unlawful attempt may not
have been an interference with the crew members' duties.
I do not know how the airline will address this inquiry, but I think it
may be difficult to describe any flight crew duty that requires the removal
of a lawfully boarded passenger, for the sole purpose of accommodating
an airline employee who wishes to subsequently board the aircraft as a
nonrevenue passenger. In the absence of such a duty, it seems the airline may
be hard-pressed to claim interference with any duty.
I have heard some suggestions that the exigent circumstances of the
accommodated flight crew (needing to travel to crew a flight the next
day) created a duty. I am not sure I agree. Airlines have reserve crews
to staff a flight when the primary crew is unavailable, so travelling
to another location to staff a flight is not necessarily an exigent
circumstance. More importantly, that is not one of the justifications for
refusal to transport that is listed in the contract of carriage.
There are probably other facts that need to be revealed, but based on
what the media initially reported, it appears the flight crew may not have
had a legal justification for removing this passenger. If that is true, then
Chicago Aviation Security Officers would likewise have had no legal basis
for removal of the passenger. And in the absence of a good faith legal
basis for removing the passenger, it is possible that the forcible removal
of the passenger may have represented a battery and/or a denial of rights
under color of law, rather than a legitimate exercise of police powers.
While it is likely this will be resolved through a quiet settlement, I
hope the public gets to see how this plays out. Understanding our rights
is important, whether we are flying or operating an avionics repair
station. Incidents like this help provide an opportunity to examine those
rights and better understand the limits of those rights. q
