Installations of ADS-B
Out systems
The following information is from the
Federal Aviation Administration March 2, 2016,
memorandum titled: Installation Approval for
ADS-B Out Systems.

Question:

Is the installation of ADS-B a major
alteration?

Answer:

For ADS-B Out systems: Yes, they are to be
treated as if they are major even if it is only a
software upgrade from a non-ADS-B transponder
to an ADS-B compliant transponder.
As is the case for most avionics installations,
especially in light, general aviation aircraft, the
physical installation of ADS-B Out systems are
seldom a modification that would rise to the level
of a major alteration. However, the FAA ADS-B
Out memorandum dated March 2, 2016, requires
the filing of FAA Form 337 and by extension
requires follow-on ADS-B Out installation to be
treated as if they were a major alteration.
On the other hand, lacking any specific
guidance and policy to the contrary, ADS-B In
systems are considered normal avionics and the
standard regulatory analysis of the alteration
(major-minor) is used to capture the appropriate
level of the modification. The FAA's Technical
Paper AFS-360-2017-1 explains the requirements
for ADS-B In systems.
15. What are the installation and approval
requirements for ADS-B In equipment?
The requirements for installation and
approval of ADS-B In equipment are
dependent on the intended function and
use of the data provided. In most cases,
alterations to aircraft that enable ADS-B In
functionality will be accomplished concurrent
with ADS-B Out system installations.
Typically, these installations are completed

using data from a single approval (TC, STC,
etc.) and enable the display of advisory-only
traffic and aviation relevant information.
Installations on other aircraft, such as Part
25 aircraft, may enable more advanced
ADS-B In functionality such as In-Trail
Procedures, Interval Management, and
Cockpit Display of Traffic Information
Assisted Visual Separation. In most cases,
equipage and operational use of advanced
ADS-B In functionality require FAA
airworthiness approval and operational
authorization due to the higher level of
criticality and safety associated with them.
The following guidance is applicable
to permanently installed ADS-B In
equipment that meet the requirements of
TSO-C195b, Avionics Supporting ADS-B
Aircraft Surveillance Applications. Refer
to FAA Advisory Circular 120-76 (as
revised) Guidelines for the Certification,
Airworthiness, and Operational Use of
Electronic Flight Bags when applicable.
The FAA does not provide approval for
portable electronic devices such as those
used to display ADS-B traffic and weather
information and such devices are outside the
scope of this guidance.
Equipment Installation Guidance for ADS-B
In Advisory-Only Functionality:
ADS-B In Advisory-Only functionality
includes manufacturer provided functionality
enabled by ADS-B (e.g., traffic and altitude
alerting) and display of data provided
through the FAA ADS-B broadcast services
(TIS-B and FIS-B). In most cases, alterations
to aircraft that enable ADS-B In functionality
will be accomplished concurrent with an
ADS-B Out system installation. Typically,
these installations are completed using data
from a single approval (TC, STC, etc.).
