The installation of the new
non-traditional products
The following is a constant question and a broad
misunderstanding regarding the new products as
discussed in the June 2018 edition of Avionics News.

Question: What are the installation

requirements of the new generation of nontraditionally approved avionics equipment?

Answer: To paraphrase the rock band Talking

Heads, the requirements are the "same as they
ever were."
Most of the conversation lately has focused on
the design and production of a new generation
of avionics equipment. However, beyond all the
fanfare, the design and production of these new
products are "approved" by regulations. 14 CFR
§ 21.8 and § 21.9 are key. As discussed in the
June issue of Avionics News, all the new products
are, in fact, approved.
Along with the confusion of the parts

approvals, the installations are even more
confusing. However, the installation of these new
products is still governed as an alteration under
Part 43. As is required for ALL alterations, it is
the installer (not the OEM) who must evaluate
this particular alteration with this particular
aircraft, interfaced with the aircraft's particular
equipment to determine the level (major/minor)
for this particular alteration. With very few
exceptions, every aircraft and every alteration is
unique.
For example, many people misread the FAA's
NORSEE policy and believe that ALL NORSEE
installations are minor alterations. This is not the
case. The NORSEE policy never has addressed
installation authority. The language Non-Required
Safety Enhancing Equipment (NORSEE) that
is determined to be a minor change to type
design" has been misinterpreted to mean a minor
alteration - that is not correct.
A major change in type design requires an
STC (§ 21.113) - minor changes in type design
are "approved under a method acceptable to the
FAA" (§ 21.95). For in-service aircraft, § 21.95
is satisfied with the Part 43 requirements for
alterations. While these types of non-integrated,
simple systems will likely result in a minor
alteration, the installation of NORSEE products
can and sometimes does generate a major
alteration.
