Brexit and AEA's membership:

Surviving under the
latest guidance

H

ow will Brexit affect the typical Aircraft Electronics
Association repair station member?
Although the full details are not yet known, the
prima facie thoughts have been published by the European
Commission, and these thoughts could reflect future problems for some AEA members. In summary, U.K.-originated
EASA Form 1 will be considered invalid in the European
Union (and for installation on EU-registered aircraft) after
Brexit.
The European Commission published a notice to stakeholders detailing the anticipated consequences of the U.K.'s
withdrawal from the European Union's aviation safety rules.
The notice explains that when the U.K. leaves the European
Union, then from an EU perspective, this action will (1)
invalidate all certificates issued by the U.K. Civil Aviation
Authority, and (2) invalidate all certificates issued by the
U.K. CAA certificate holders. All of these certificates will be
invalid as of the withdrawal date, which is currently set for
11 p.m. on March 29, 2019.
The notice explains that "the products, parts and appliances concerned will no longer be considered as certified in
accordance with Article 5 of the Basic Regulation." Article 5
of the Basic Regulation provides the legal foundation for the
issue of an EASA Form 1 for a part or appliance. In a practi40

cal sense, if you have an EASA Form 1 for a new part and it
was issued in the U.K., then the EU will no longer recognize
it as a valid document after Brexit. This means that parts in
your inventory that bear EASA Form 1 may have to be segregated and identified as "U.K." and "EU," in order to ensure
that if they are still in inventory after Brexit, that they can be
used for customer aircraft that are legally able to accept those
parts.
This notice is significant, because parts that are considered acceptable by 10:59 p.m. on March 29, 2019, will not
be grandfathered into the EU system at 11:01 p.m. on that
same day (after the withdrawal date). This means that those
parts will have a more-limited utility as a consequence of this
change.
This will affect repair stations outside of Europe, as well as
those in Europe. Many U.S.-based repair stations hold EASA
certification. As of the withdrawal date, those U.S.-based
EASA-145 repair stations will not be allowed to install avionics on EU-registered aircraft if the avionics bear an EASA
Form 1 that was issued under the authority of the United
Kingdom.
As the European policy is written, this could mean that
avionics and articles manufactured in the United Kingdom
may no longer be acceptable for installation in EU-registered
