is entitled to a repair station certificate (§ 145.53).
If you consider commercial operations, again, not
discounting the limitations, an applicant may be issued
an Air Carrier Certificate or Operating Certificate if
the administrator finds that the applicant meets the
applicable requirements of Part 119 (§ 119.39). In
these, as well as all certificates, the FAA established
the "minimum" safety standards, determines that the
company meets the minimum standards, and freely
allows the business to exceed those standards as the
business determines. All except one certificate - yep, the
Aviation Maintenance Technician schools. In the case
of 14 CFR Part 147, the FAA not only establishes the
minimum standards but then mandates that the curricula
meet the minimum standards and discourages the
schools from exceeding these bare-bone minimums.
§ 147.38 Maintenance of curriculum requirements.
(a) Each certificated aviation maintenance
technician school shall adhere to its approved
curriculum. With FAA approval, curriculum
subjects may be taught at levels exceeding those
shown in Appendix A of this part.
(b) A school may not change its approved
curriculum unless the change is approved in
advance.
If, by chance, a school should inadvertently exceed
the minimum standards, it is subject to fines and
discipline.
It is time to change the paradigm. Later this year,
the FAA will be submitting 14 CFR Part 147 for a
supplemental rulemaking. § 147.38 must be changed
so the FAA only assures that every certificated school
meets or exceeds the minimum safety standards;
however, it must stop micromanaging the curricula or
the technicians who graduate from the Part 147 schools
will continue to trail technology by a generation or two.
While frustrating, this has not been a critical issue.
From an airframe and engine perspective, the technologies
haven't changed much in the last couple of generations. On
the avionics and electronics side, however, the technology
is advancing at a breakneck pace.
Can you imagine if the avionics technician training
was saddled with teaching pre-stage power amplifiers
and electron tubes in printed circuit boards? Sure,

you might come across a few novel examples of this
40-year-old technology, but in today's computerized
world of digital electronics, touchscreen operations and
synthetic vision systems are the future now.
How is avionics different than maintenance?
Maintenance is governed by Subpart D, and avionics and
electronics are governed, as are all the none-mechanic
(A&P) trades, under Subpart E for repairman.
To qualify as a repairman, you must either meet an
experience requirement or a training and education
requirement. While the A&P (and the Part 147 schools)
is saddled with prescriptive curricula, the repairman is
"allowed" to be trained on the actual job. The repairman
regulations allow an individual who has "completed
formal training that is acceptable to the administrator
and is specifically designed to qualify the applicant for
the job on which the applicant is to be employed" to be
certificated as a repairman.
But as they say, "There's no free lunch!" As we know,
the repairman certificate is not exportable; that is, the
technician cannot take it with them from one employer
to another.
To solve this issue, the Aircraft Electronics
Association has spent the better part of the last 15
years working with the National Center for Aerospace
and Transportation Technologies to design, develop
and promote a transportable certificate for the avionics
and electronics community without the burden of
government regulatory challenges. This has been
accomplished through the NCATT Aircraft Electronics
Technician standard and the four technology-specific
endorsements.
Now that the AET and its endorsements have matured,
the AEA will be petitioning the FAA later this year for
acceptance of the NCATT certification as an acceptable
means of compliance to 14 CFR 65.101, thereby
creating an FAA-recognized industry standard for the
certification of avionics and electronics technicians - all
of this without the burden of rulemaking.
Rulemaking is the Achilles heal in all of this. The
FAA has spent more than 40 years debating the A&P
curricula, and the current rulemaking was published
in 2015 and is nowhere near complete. During all of
this, the avionics repairman has remained responsive to
technology, able to keep up with modern demands, and
an efficient and effective employee who "is capable of
performing their assigned tasks." q
