Drug and alcohol
prevention program
The following is from the Federal Aviation
Administration's frequently asked questions.

Question:

Do noncertificated helpers who perform some
maintenance duties as part of a process under direct
supervision need to be covered under a drug and
alcohol testing program even though they will not
sign off the work?

Answer:

Yes.
According to the FAA: "All employees who conduct
maintenance or preventive maintenance are required to
be covered by an FAA drug and alcohol testing program
regardless of whether they sign off the work or not."
Applicable regulations include both 14 CFR Part 43 and
14 CFR ยง 120.105.

current activities
During the past several months, there has not been
visible regulatory activity coming from the TCCA.
This does not mean there is no action at all. Last
month, an update was provided on the regulatory
modernization process and what to expect from that.
The TCCA is also working on various other activities
either directly related to this modernization process or
other items that need attention.
Here are some items of interest to AEA members:
*	 The adoption of the new Part 23 as issued by
the Federal Aviation Administration and the
European Union Aviation Safety Agency. This
has been in the works for some time but has not
been given the priority. This is due to the fact
that no applications have been received wishing
to use new design requirements, and the internal
review needed to be completed. The review
brought up a concern with one of the new
requirements that covered landing requirements.
There was some concern the language would
not require a "safe landing," as it discussed
substantial damage or serious injury. However,
in consultation with the FAA, it was shown that
the intent was to require a safe landing under
normal circumstances, but in abnormal cases,
there should be sufficient protection to the
