The following is from the Federal Aviation
Regulations; the FAA's Order 8130.2J; and FAA
April 1, 2019, policy statement for issuing air
traffic control authorizations.

Question:
Can my customer get a "ferry permit" after Jan.
1, 2020, for the installation of ADS-B?

Answer:
They "should" not. Not because they won't be
issued, but rather because they should not be required.
First, a special flight permit is issued for an aircraft
that may not currently meet applicable airworthiness
requirements. The installation and use of ADS-B
is an airspace requirement, not an airworthiness
requirement. Notwithstanding any other discrepancy,
an aircraft without ADS-B is perfectly airworthy and
eligible to fly in non-ADS-B airspace but may not enter
ADS-B airspace.
14 CFR § 21.197 Special flight permits.
(a) A special flight permit may be issued for an
aircraft that may not currently meet applicable
airworthiness requirements but is capable of safe
flight, for the following purposes:
(1) Flying the aircraft to a base where repairs,
alterations, or maintenance are to be performed, or
to a point of storage.
(2) Delivering or exporting the aircraft.
(3) Production flight testing new production aircraft.
(4) Evacuating aircraft from areas of impending
danger.
(5) Conducting customer demonstration flights
in new production aircraft that have satisfactorily
completed production flight tests.
Again, ADS-B is an airspace rule not an aircraft

rule. The absence of ADS-B is not in and of itself an
airworthiness issue.
14 CFR § 91.225 Automatic Dependent
Surveillance-Broadcast Out equipment and use.
a) After Jan. 1, 2020, and unless otherwise
authorized by ATC, no person may operate an
aircraft in Class A airspace unless ...
(b) After Jan. 1, 2020, and unless otherwise
authorized by ATC, no person may operate an
aircraft below 18,000 feet MSL and in airspace
described in paragraph (d) of this section unless ...
Just like the transponder rule (14 CFR § 91.215
(d)), the ADS-B regulation (14 CFR § 91.225) contains
a provision for requesting ATC authorized deviations
and the operation of an aircraft that is not equipped
with ADS-B Out.
14 CFR § 91.225 ADS-B Out equipment and use.
(g) Requests for ATC authorized deviations from
the requirements of this section must be made to the
ATC facility having jurisdiction over the concerned
airspace within the time periods specified as follows:
(1) For operation of an aircraft with an inoperative
ADS-B Out, to the airport of ultimate destination,
including any intermediate stops, or to proceed to a
place where suitable repairs can be made or both,
the request may be made at any time.
(2) For operation of an aircraft that is not equipped
with ADS-B Out, the request must be made at least
one hour before the proposed operation.
On April 1, 2019, to further clarify how to request
an ATC deviation, the FAA published its policy for
issuing air traffic control authorizations to persons
seeking to operate aircraft that are not equipped with
ADS-B Out equipment in ADS-B airspace after Jan. 1,
2020.
