On April 16, 2019, the Federal
Aviation Administration published a supplemental notice of proposed rulemaking
continuing the 2015 notice of proposed
rulemaking to 14 CFR Part 147.
Comments received during the initial
NPRM suggested expanding the scope
of that proposal to allow competencybased training and satellite training
locations and to eliminate the national
passing norms specified in the quality
of instruction requirements.
After analyzing the comments, the
FAA agrees with expanding the scope
of the proposal. The FAA is proposing
to allow the option of competencybased training and satellite training
locations. Additionally, the FAA is proposing to amend the quality of instruction requirements by replacing the
national passing norms with a standard
pass rate.
Unfortunately, the FAA has not proposed to eliminate the micromanagement of the schools as it has for every
other certificated entity and transition
to a performance-based standard.
The requirement that a "school
may not change its approved curriculum unless the change is approved
in advance" (ยง 147.38(b)) must be
amended to an approved minimum
standard but allow the schools to freely
meet or exceed those standards as
their students and their students' future
employers demand.
Comments must be received no later
than June 17, 2019. Submit your comments at regulations.gov using docket

CARAC Plenary Session 2019
The TCCA played host to the 18th CARAC Plenary session in Ottawa, April 24-25.
The purpose of the plenary session was to report on past accomplishments and present to CARAC members the current plans for regulatory development. It also was an
opportunity for the TCCA to have discussions around emerging issues or other items
that may need feedback from industry to move forward effectively. During this session, the TCCA laid out the regulatory plan though 2022.
It should be noted that the TCCA made it very clear that, while CARAC uses the
word regulatory in its title for this committee, it is committed to using all tools at
its disposal to implement the TCCA mandate to provide a safe aviation system in
Canada. This means that all items proposed by the TCCA during this CARAC session and any other initiative will be reviewed to determine the best instrument to use
in the given situation. Therefore, it is possible that policy, guidance, ministerial orders
or other tools can be used to more quickly implement changes. This is in recognition
that not everything needs to be a regulation or that the current regulation may already
allow for some flexibility; therefore, a policy issue may be the best route. These other
methods will still go through a proper review with industry in the CARAC process.
During this meeting, the TCCA committed to engaging industry more and earlier in
the process. It recognizes that the best outcomes will come from all the experts being
involved.
There were more than 30 items introduced during the session. The following are

*	 The TCCA is currently conducting a review of SMS and its implementation.
The objective is to determine SMS policy, and identify issues and opportunities to refine SMS. This includes preparing compliance and differences
documents for the ICAO Annex 19 (State Safety Plan) implementation for
November 2019 for aviation sectors, and to propose options for further SMS
development and implementation.
*	 An NPA for CAR 521 is to be issued in June 2019. This will introduce a series
of changes to this regulation with the intent to resolve many outstanding issues
with it. A full review of this NPA will be presented here once it is received.
*	 The regulatory review introduced last year is progressing after identifying
some specific issues. The way forward with this review will be to develop
policy to take a risk-based or performance-based approach to writing new
regulations. This means more flexibility for the TCCA and the industry. The
plan is to submit six regulatory packages per year.
*	 Currently, there are initial consultations being conducted on the use and
implementation of LDRs in response to the Transportation Safety Board of
Canada's recommendation (A18-01). Regulations, standards and guidance
material are being considered. Some of these items will be developed to
address the design aspects and installation on aircraft. However, the TCCA
is also considering requiring the installation of LDRs in newly manufactured
aircraft.
*	 The TCCA is working in collaboration with industry (including educational
institutions) to develop a national strategy to address the labor shortage in this
industry. An initial forum was held last October. The outcomes of this meeting
