to the public. Although hard to find, there are several pages
available providing information on what is happening.
On the modernization team's website, there is a link
to the summary on the consultations and links to what is
currently being planned for regulatory or policy changes.
Three themes came out of the consultation: A need for more
flexibility in the regulatory framework; a need for more
coordination among jurisdictions and collaboration with
industry; and a need for clarity and certainty within the
regulatory framework. Two items of interest came out of the
consultations.
The first is the initiative to have the minster of the
Department of Transport authorized to issue ministerial
orders. One of the consistent comments was that the
regulatory process takes too long and does not keep pace
with changing technology, as well as the fact that often
regulations are written in the context of the technology at the
time. This limits innovation and advancement of Canadian
aviation business. The ability to issue ministerial orders will
provide the TCCA with another vehicle to more quickly
implement new requirements. This is in conjunction with the
concept introduced by the TCCA at the CARAC plenary; it
will look to all the tools it has to implement required change
instead of always using regulations. The plan is for approval
of this by the governor in council in late 2019 or early 2020.
The second is the TCCA's plan to help address the labor
shortage in aviation. The plan is to work with a broad group
of industry representatives and associations to determine
multiple paths to increase entrants into the aviation sector.
One of the ideas is to look at leveraging developing
technology and offer training solutions. A notice of proposed
amendment is currently in development to change the
regulations on approved training organizations, as well.
Expect further developments to come over the next two
years with a Gazette I publication planned for 2021.
Other initiatives to expect in the coming year are the
publication in Gazette I for the new aircraft certification fees
and use of portable electronic devices.

Embodiment of SMS requirements into
Part-145 and Part-21 (NPA 2019-05)
This notice of proposed amendment proposes to
consider the applicability of safety management systems to
Part-145 approved maintenance organizations, as well as
to production and design organizations that are approved
in accordance with Subparts G and J of Part-21.
Published on April 17, 2019, the comment period has
been extended until Sept. 6, 2019.

Management of information security
risks (NPA 2019-07)
This NPA introduces requirements to be met by
organizations involved in civil aviation activities, as
well as by their competent authorities, to identify,
protect from, detect, respond to and recover from
those information security incidents that could
potentially affect aviation safety. For the purpose of
this NPA, information security risks are those that
may compromise the confidentiality, integrity and
availability of information being stored, transmitted
or processed through the aeronautical information
systems used in civil aviation.
These proposed requirements apply to the
competent authorities and to the following
organizations:
*	 Production organizations and design
organizations that are required to comply
with Subparts G and J, respectively, of
Section A of Annex I (Part-21) to Regulation
(EU) No. 748/201217.
*	 Maintenance organizations that are required
to comply with Section A of Annex II (Part145) to Regulation (EU) No. 1321/201418.
*	 Continuing airworthiness management
organizations that are required to comply
with Section A of Annex Vc (Part-CAMO)
to Regulation (EU) No. 1321/2014 (as per
Opinion No. 06/201619).
*	 Air operators that are required to comply
with Annex III (Part-ORO) to Regulation
(EU) No. 965/201220.
*	 Aircrew training organizations, aircrew aeromedical centres and FSTD operators that are
required to comply with Annex VII (PartORA) to Regulation (EU) No. 1178/201121.
*	 ATCO training organizations and ATCO
aero-medical centres that are required to
comply with Annex III (Part ATCO.OR) to
Regulation (EU) 2015/34022.
*	 ATS, MET, AIS, DAT, CNS, ATFM and
ASM providers and the network manager
that are required to comply with Annex III
(Part-ATM/ANS.OR) to Regulation (EU)
2017/37323.
*	 Aerodrome operators and apron management
service providers (as per Opinion No.
02/201424) that are required to comply with
Annex III (Part-ADR.OR) to Regulation (EU)
No. 139/201425.
The deadline to submit comments is Sept. 27,
2019.
