TCCA publishes changes to CAR
561/573 in respect of PRM duties
The government operates a committee
referred to as the Standing Joint Committee
for the Scrutiny of Regulations. The duty of
the SJCSR is to review regulations issued by
government departments to ensure they are
appropriate and meet the requirements of the
enabling legislation. Since 2009, the SJCSR has
been requesting the TCCA review the ability to
assign a monetary penalty for noncompliance to
a certificate holder's manual. The Aeronautics
Act has been interpreted to not allow for this
type of penalty. As a result, the TCCA has made
changes to 11 instances in the CARs requiring
compliance to the approved manual. The most
notable to AEA members is with CAR 561 and
CAR 573.
The change in CAR 561 is to remove
561.07(3), which is a requirement for
any person who performs work under the
manufacturing certificate to comply with the
approved manual. This was removed as it is
a duplicate requirement, and it is the ultimate
responsibility of the accountable executive to
ensure all persons comply with the approved
manual.
The change to CAR 573 occurs with the
removal of 573.04(2), which required the PRM
to manage the activities in accordance with the
approved manual. This also resulted in a change
to 573.03(1)(e), which made a reference to
573.04(2). Again, the reason for this change was
that it was determined the provisions related
to the accountable executive were sufficient to
ensure the approved manual is followed.
These changes quietly came into force
in August 2019 and were managed by the
regulatory review group that has been tasked
with the overall review of the CARs. They are
in the process of several programs to revise the
CARs in order to modernize them and to deal
with so-called "irritants" in them. The only
consultation on this change was conducted when
the NPA was published in March 2019. In the
end, these changes do not affect manufacturers
or AMOs in any significant way. The TCCA has
not fined any organization in respect of these
changed requirements in over 10 years and
has other tools to ensure that organizations are
following their approved processes.

Australia
The following message is from Shane Carmody,
director of aviation safety for the Australian
government's Civil Aviation Safety Authority.
I am pleased the first low-cost automatic
dependent surveillance-broadcast equipment
suitable for visual flight rules aircraft has
been accepted by CASA.
This is the practical outcome of work that
started back in 2017 to give owners of aircraft
that engage exclusively in visual flight rules
operations more options for voluntarily fitting
ADS-B equipment.
While all aircraft that operate under the
instrument flight rules must be fitted with
ADS-B, it is voluntary for the visual flight
rules sector. When we consulted on the
proposals for low-cost ADS-B in 2017/18,
there were 80 submissions, with almost half
of the respondents saying these changes
would be a positive incentive to install ADS-B
equipment.
CASA believes fitting ADS-B technology in
visual flight rules aircraft will further enhance
safety by increasing the visibility of aircraft to
air traffic control and other aircraft.
The first equipment accepted by CASA is the
uAvionix SkyEcho 2 ADS-B transceiver. This
meets the technical standards for portable
self-contained electronic conspicuity devices.
It can transmit aircraft position information
and receive position information from other
aircraft. For a device to be used in Australia,
CASA requires the manufacturer to provide
a statement of capability and conformance
with the relevant provisions in Civil Aviation
Order 20.18. Electronic conspicuity devices
with a valid statement are then listed on
the CASA website, and these may be used
in Australian airspace in accordance with
specified operating requirements and limits.
