application and evaluation of compliance includes
performance-based oversight that take into account
the amount, type, scope and complexity of work
performed and the certificate holder's size.
In order to fully understand the regulations of today,
we must research and understand the history of the
regulations. To that end, I have spent much of the past six
months studying the history of repair stations, including
personnel and performance. The earliest introduction
of the repair station as we know it today dates back to
1938, and with few exceptions, the basic regulations are
unchanged. That said, there has been continuous growth
of prescriptive language to each of the requirements.
Here is an example. The current section 145.223 FAA
Inspections, requires that " a certificated repair station
must allow the FAA to inspect that repair station at any
time to determine compliance with this chapter. " In 1940,
the language was better. Section 52.36 Inspection, also
required access to the FAA but with a better description of
the purpose: " An applicant for a repair station certificate
shall offer full cooperation with respect to any inspection
or examination which may be made of such applicant,
upon proper request by any authorized representative of
the authority, prior or subsequent to the issuance of such
certificate. "
While it can be argued that modern aviation started
with the introduction of powered flight in 1903, from a
regulatory process, it truly started in the United States
with the Air Commerce Act of 1926 that placed both
commercial regulatory authority and safety regulation
in the Department of Commerce. The ACA was quickly
followed up with the Civil Aeronautics Act of 1938 that
established the Civil Aeronautics Authority within the
Department of Commerce (an early predecessor of today's
Federal Aviation Administration). The Civil Aeronautics
Authority established the civil air regulations (the
predecessor of the current federal aviation regulations),
which was first published in 1938.
The 1930s also introduced two of the foundational

documents that I use every day: the Federal Register
and the Code of Federal Regulations. The Federal
Register Act of 1935 created the framework for both
documents. The Federal Register Act stated that " all
documents required or authorized to be published under
section 5 shall be printed and distributed forthwith by
the Government Printing Office in serial publication
designated the Federal Register. " This simple language
has led to the daily publication of the Federal Register
documenting the rulemaking activities of every executive
branch office. While the Federal Register Act of 1935 was
approved on July 26, 1935, the first issue of the Federal
Register was not published until March 14, 1936.
During the National Archives' (publisher of the
new Federal Register) first year of operation, its
Administrative Committee proposed amending the
Federal Register Act to provide for a codification,
rather than a mere compilation, of the vast amounts
of regulatory material. The proposal to amend the Act
and the resulting codification of regulations began with
Public Law 75-158 as approved by President Franklin
Roosevelt in June 1937. As prescribed by the Public
Law, each agency was to prepare and file with the
Administrative Committee a complete codification of
all documents that had legal effect and in force on June
1, 1938. On Oct. 11, 1938, the president authorized a
new publication called the Code of Federal Regulations.
The new Code was made up of 50 titles representing a
division by subject areas. One of those titles, title 14,
addressed civil aviation. Hence, 14 CFR was created
and is the foundational regulatory document for civil
aviation to this day.
In June 1946, 10 years after the Federal Register Act
was put in place creating transparency with respect to the
results of rulemaking, another important law was passed
that recreated transparency of the entire rulemaking
process, not only the final results. This law, the
