Be careful
what you ask for
D
uring the past month, I have had several
calls from Aircraft Electronics Association members asking "...but where does
it say I can do that?" As Mona Lisa Vito so eloquently
stated in the film My Cousin Vinny, "It's a (bogus) question; it's impossible to answer." Vito was answering a
question about the "correct ignition timing on a 1955 Bel
Air Chevrolet with a 327 cubic-inch engine and a fourbarrel carburetor." For avionics professionals, the question is normally associated with someone asking, where
in the Federal Aviation Administration policy or guidance
is it stated? In essence, where is my permission?
As my friend Sarah so forcefully states: "If the
regulations do not prohibit it, then it is permitted."
Asking for explicit "permissive" language in many of the
regulations and guidance is simply a bogus question and
impossible to answer.
Since she is a lawyer, she added this caveat:
"Generally, if the action is not prohibited by a regulation,
it is allowed. In other words, most rules read: You
shall, or you shall not. That is, each person performing
maintenance ... shall use ... or ... no person may..."
To highlight Sarah's points, look no further than the

regulation addressing the privileges and limitations of
a repair station. Here the regulations clearly state that
a "certificated repair station may perform maintenance,
preventive maintenance, or alterations in accordance with
Part 43 on any article for which it is rated and within the

limitations in its operations specifications" (§ 145.201(a)
(1)). Further into this same regulation, you can read
that a "certificated repair station may not approve for
return to service any article after a major repair or major
alteration unless the major repair or major alteration
was performed in accordance with applicable approved
technical data" (§ 145.201(c) (2)).
To fully understand these statements, you must
invest your time and effort into understanding what
the regulations do say. Unfortunately, as an aircraft
