maintenance business owner, you have to know the
business, tax, and personnel management regulations,
along with the technical and marketing information for
the products you sell and service. But you also must
know the aviation regulations that not only guide the
performance of your tasks but also direct the design and
operation of your business.
Many of the questions I receive are based on wanting
someone (usually the FAA) to tell them "yes or no" that
they can or can't perform a certain task, or to tell them
"how to" do something. They want a prescriptive answer
to a question. However, it is impossible to answer. Or at
least, it's impossible to answer and maintain the intent
of the regulations and the intent of the U.S. Congress
where it has driven agencies to adopt performance-based
regulations. We, as industry, have lobbied for decades for
performance-based regulations that allow us to design

and operate our businesses while limiting the FAA's
oversight to the safety standards.
If we look back to the 1999 FAA's notice of proposed
rulemaking, we see the transition from a prescriptive
inspection procedures manual to a performance-based
repair station manual and quality assurance system.
In the NPRM, the FAA proposed to eliminate the
requirement that repair stations maintain an IPM and
replace it with a requirement that repair stations maintain
an approved repair station manual that covers all of the
repair station's technical operations. The FAA further
recognized the Joint Aviation Authorities requirement
that each JAA-approved maintenance organization
establish an independent quality system that monitors
compliance with and adequacy of the procedures used
to ensure good maintenance practices and airworthy
aircraft and aircraft components. As a result of its review
and−investigations
of success of quality assurance and
