Return to service of
foreign-registered aircraft
The following information is from the Federal
Aviation Administration Regulations.

Question:

Can I return to service an aircraft or
component following maintenance?

Answer:

Maybe: with a strong leaning toward no.
"May you" is controlled by the state of
registry of the aircraft. To return to service
an aircraft or component of that aircraft, you
must have maintenance and return to service
authority granted by the state of registry
of the aircraft. In other words, for a U.S.registered aircraft, you must have Federal
Aviation Administration maintenance and
return to service authority; for an aircraft
registered within the European Union, you
must have European Union Aviation Safety
Agency maintenance and RTS authority; and
for Canadian aircraft, you need Canadian
authority.
There are generally four ways this
authority may be granted. First, direct
regulatory authority; second, via a
bilateral aviation safety agreement, state
to state memorandum, or other agreement;
third, through a regulatory recognition;
and fourth through a one-off CAA

acceptance of you and your repair station.
Likely the most visible agreement is the
United States/European Union Bilateral
Aviation Safety Agreement. In this case,
the BASA recognizes each authority and
empowers them to manage the certificates
and authorities of the foreign person. The
EASA provides oversight of FAA repair
station certificates in Europe, while the
FAA provides oversight of EASA repair
station certificates in the U.S. In both
cases, the RTS authority is still granted
by the state of registry of the aircraft.
Outside of the U.S./Europe agreement,
many countries have a BASA-like
arrangement through a lesser document
such as a memorandum of understanding.
Then you have foreign maintenance
and RTS authority contained with the
regulations. For the U.S., 14 CFR 43.17
grants Canadian maintainers the authority
to work on and return to service U.S.registered aircraft. Within the Australian
regulations, they designate recognised
country with certain defined modifications
and repair authorities (Regulation 21.010).
Not too far from the regulatory authority,
many countries, such as the Isle of Man,
will publish a policy document where
they recognize specific authorities. And
finally, often, you can work one-on-one
with the authority of the state of registry
to receive a one-off authority to perform
maintenance on the aircraft.
In each instance, not only do you need
to identify and document the source
of your authority, but you also need to
identify any maintenance record-keeping
requirements that may be unique to this
particular project. q
