EQUIPPING EXPERIMENTAL,
AMATEUR-BUILT AIRCRAFT FOR IFR

CFR § 91.205 apply to EAB aircraft for those desirous of
instrument-flight capability.

To gain approval for IFR operations, the operating
limitations must contain the following or a similarly
worded statement: "After completion of phase I flight
testing, unless appropriately equipped for night and/
or instrument flight in accordance with § 91.205, this
aircraft is to be operated under VFR, day only."
With this entry, the aircraft can be operated under IFR
once the initial flight test period is complete, so long as it's
equipped in accordance with Part 91, section 91.205.
This regulation details the minimum equipment required
for day/VFR, night/VFR, and IFR flight operations. §
91.205 also seems to limit IFR to "powered civil aircraft
with standard category U.S. airworthiness certificates."
Experimental aircraft don't get a standard-category
airworthiness certificate.

Simply put, for an aircraft to be used in IMC, or
merely under an instrument flight plan, the avionics and
other equipment must meet the requirements of 14 CFR
§ 91.205. The rest of the requirement generally applies
to EAB aircraft of all categories, for VFR and IFR
operations.
Per the FAA, instrument operations in experimental
aircraft is acceptable, provided compliance with these
points:
*	 The aircraft has satisfactorily passed its flight
test period.
*	 The aircraft's equipment complies with the
equipment requirements of 14 CFR § 91.205.
*	 And the aircraft has the appropriate statements
in the operating limitations.
