When this language was challenged during the NPRM
process, the FAA subsequently revised the language
to the current regulatory language: " A certificated
repair station must document, in a format acceptable
to the FAA, the individual employee training required
under paragraph (a) of this section. These training
records must be retained for a minimum of two
years, " deleting the " duration of each individual's
employment " language.
" In adopting this rule, the FAA revised the
proposal to require repair stations to retain
employee training records for a minimum of
two years. "
The employment-plus-two-years language is
contained in the FAA Advisory Circular 145-10
but only in the sample training programs contained
within the appendixes. In fact, the AC separately
requires that the " repair station must have procedures
to document each individual's training to ensure
compliance with 14 CFR Part 145, § 145.163. This
includes defining the extent of training records and
establishing a system for creating, accessing, and
retaining training records for two years after the
training is provided. "
To highlight this further:
" With regard to commenters' concerns
regarding the content of the training records,
the FAA notes that the language 'in a format
acceptable to the FAA' refers to the media
by which the records will be submitted, for
example electronically. When submitting its
training program for approval, a repair station
should delineate the items it intends to include
in the records. "
While I could go on about the technical content of
the required training programs, I want to get back to
the fundamental question: Is the repair station training
program a product or a process?
One could certainly argue that the repair station
training program is a product. Simply look to the
regulation: " A certificated repair station must have
and use an employee training program approved by
the FAA that consists of initial and recurrent training. "
14 CFR 145.163 (a))
But when we look toward the rest of the regulation,
we see that it is a performance-based process. The
training program must ensure each employee assigned
to perform maintenance, preventive maintenance, or
alterations, and inspection functions is capable of

performing the assigned task. (14 CFR 145.163(b))
We cannot truly look to the language of 145.163
without the rest of Part 145 subpart D on personnel.
Each certificated repair station must " Provide
qualified personnel to plan, supervise, perform,
and approve for return to service the maintenance,
preventive maintenance, or alterations performed
under the repair station certificate and operations
specifications. " (§ 145.151 (b))
In addition to the basic requirement to have
" qualified personnel to plan, supervise, perform, and
approve for return to service, " the repair station must
also " Ensure it has a sufficient number of employees
with the training or knowledge and experience in the
performance of maintenance, preventive maintenance,
or alterations authorized by the repair station
certificate and operations specifications to ensure
all work is performed in accordance with Part 43 "
(§ 145.151 (c)). And finally, § 145.151 (d) requires
that the repair station " Determine the abilities of its
noncertificated employees performing maintenance
functions. "
Looking into the other sections contained within
subpart D, we see that supervisors and inspectors are
required to be " Thoroughly familiar with the applicable
regulations in this chapter. " (14 CFR Chapter 1)
Inspectors are required to be thoroughly familiar
with the inspection methods, techniques, practices,
aids, equipment, and tools used to determine the
airworthiness of the article. In addition, inspection
personnel must be thoroughly familiar with the
applicable regulations in this chapter and with
the inspection methods, techniques, practices,
aids, equipment, and tools used to determine the
airworthiness of the article.
So, is the repair station training program a product
or a process? Simply, the repair station training
program is the documented process that you use to
show compliance with the requirements of 14 CFR
Part 145, Subpart D - Personnel. It is your process
that you use to assure that the technician that you
send out to work on your customer's " pride and joy "
is qualified and capable of performing the task the
customer requests.
Every business should qualify its technicians before
they are allowed to work independent of supervision.
Whether Starbucks or " XYZ Avionics, " qualifying
an employee is a fundamental process of every
successful business. The fact that the FAA reviews
and approves a repair station's program is incidental
to the fundamental performance-based process that the
program captures. q
