Title 14 CFR, Part 3, § 3.5, Statements about Products, Parts, Appliances and Materials, (a) through (d) became effective on Oct. 17, 2005. The final rule was published in the Federal Register on Sept. 16, 2005, (70 FR 54821-54832). This rule bans false or intentionally misleading statements about the airworthiness of typecertificated products, and the acceptability of products, parts, appliances and materials for installation on typecertificated products. The rule is intended to prevent

people from representing an item as suitable for installation on a type-certificated product when it is not. Part 3 is intended to provide assurances that aircraft owners and operators, and persons who maintain aircraft, have factual information to determine whether a product, part, appliance or material may be installed on a given type-certificated product. Replacement and Modification Parts
The following information is from various Federal Aviation Regulations and FAA Policy.

QUESTION: Do all modification and replacement parts have to be FAA approved? ANSWER: Yes and no. The answer depends on the part, whether you are the installer, manufacturer or the distributor. There is no easy one-size-fits-all answer to the question. There are as many opinions as there are parts. One of the biggest problems is a misunderstanding of an approved part. The definition of an approved part includes not only the classic definition of an approved part as defined in Part 21, but also the colloquial term of an acceptable part as defined in FAA Advisory Circular 20-62. AC 20-62 defines an acceptable part as standard parts, such as nuts and bolts, conforming to an established industry or U.S. specification; parts produced by an owner or operator for maintaining or altering their own product and are shown to conform with FAA-approved data; or, parts for which inspections and tests have been accomplished by appropriately certificated persons authorized to determine conformity to FAA-approved design data. Let’s look at the regulations and start with the manufacturer rules: § 21.9 Replacement and modification articles. (a) If a person knows, or should know, that a replacement or modification article is reasonably likely to be installed on a type-certificated product, the person may not produce that article unless it is:

Produced under a type certificate. Produced under an FAA production approval. A standard part (such as a nut or bolt) manufactured in compliance with a government or established industry specification. 4. A commercial part as defined in § 21.1 of this part. 5. Produced by an owner or operator for maintaining or altering that owner or operator’s product. 6. Or, fabricated by an appropriately rated certificate holder with a quality system, and consumed in the repair or alteration of a product or article in accordance with Part 43 of this chapter. So, from the above regulations, we know that anyone who produces a modification or replacement part must pursue explicit FAA approval. For distributors, the rules are a bit more recent. Part 3 issued in 2005 applies to any person who makes a record regarding a type-certificated product, or a product, part appliance or material that may be used on a type-certificated product, but does not apply to maintenance records made under Part 43. Part 3 essentially prohibits any person from making any intentionally false or misleading statement in any record about the airworthiness of a type-certificated product, or the acceptability of any product, part, appliance or material for installation on a type-certificated product. So, for a distributor, a replacement or modification part for a type-certificated aircraft must have some form of FAA approval. But, what does the regulation say for the installer? § 21.8 Approval of articles. If an article is required to be approved under this chapter, it may be approved: a. Under a PMA. b. Under a TSO. c. In conjunction with type certification procedures for a product. d. Or, in any other manner approved by the FAA.
